A. Account Information

We receive, store and process information that you make available to us while accessing without registering, registering or using our Services. Examples include when you:

  • Fill any form, such as when you register or update the details of your user account;
  • Access Services through a third party site (e.g. Facebook, Google+), in which case we will obtain information in accordance with Third Party’s policies and your account settings, preferences; and
  • Provide any information while communicating with Vigor

We may use your account information to send you information that complements your use of the Services. You hereby agree to use of your account information for such purpose. You may choose to opt out of any non-essential communication by unsubscribing or contacting us at hello@vigor.co.in. However, some messages are necessary for the operation of Services and may not be unsubscribed.

B. User Content

The Services allow you to provide User Content to the Services, such as workout feedback and log your fitness activities. All content submitted by you to the Services is User Content and may be retained indefinitely even after you terminate your account.

C. Log Information

Vigor collects certain information from everyone who access our Services, even without registering. This includes log data that automatically records information about the visit, such as your browser, device’s make, device operating system, incoming and exit page URLs, actions performed and IP address. This information is used to provide relevant user experience, to understand usage of Services, prevent fraud/misuse and to ensure proper functioning of Services, among other things.

D. Financial Information

We do not currently collect any financial information, such as your credit card/debit card details; this information is collected, stored by third-party payment processing companies and governed by their privacy policy.

However, we do maintain a record of your purchase activities, such as Order ID and Transaction History (but no banking details).

E. Cookies

A cookie is a small text file that we place on your device to enable various features of Mobile App. "Cookies" are used to store user preferences and to track user trends, so as to enhance your interactive experience and generally improve our Services to you. You can change your cookie settings to accept or not accept permanent or third-party cookies in your browser settings. If you do accept a "cookie", you thereby agree to our use of any Personal Information collected by us using that Cookie.

F. Usage of Information

We use information to perform operational activities, such as administer, personalise, enable access and use of Services, processing requests, sharing information and invoices.

Additionally, we also use the collected information to do internal research on our users' demographics, interests, behaviour, consumption patterns and response to Services to better understand, protect and serve our users. This information is generally compiled and analysed on an aggregated basis.

G. Other Platforms

Our Services may contain links to other websites or applications; Vigor is not responsible for practices and privacy policies of any third-party.

H. Third Party Tie-Ups

We may share personal information with our other corporate entities and affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of our services; and to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity. Those entities and affiliates may not market to you as a result of such sharing unless you explicitly opt-in.

At times, We may tie-up with third parties, brand owners or other partners and make available certain offers, events or special schemes. In such instances, Your personal information may be shared with such third parties and/or may become available to them or be disclosed to them, such third parties may have their own applicable privacy rules and We shall not be liable for the use or misuse of Your information by such third parties.

I. Securing Information

Vigor takes all reasonable technical and organisational precautions to prevent the loss, misuse or alteration of all the information stored or transmitted while accessing the Services. Despite Our endeavours to deploy all safeguards, no security system is impenetrable. By using the Services, you agree that Vigor will have no liability for disclosure of your information due to errors in transmission and/or unauthorized acts of third parties.

Note: We recommend you to not disclose any sensitive information, such as password, to anyone via mail or telephone.

J. Information Sharing and Disclosure

We will not sell or rent your Personal Information to third parties except as described in this Privacy Policy. We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to summons, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.

We and our affiliates will share / sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this privacy policy with respect to your personal information.
